FWC confirms deferral of superannuation increase for supported employees

The Fair Work Commission (FWC) has released a determination [PDF] in the Supported Employment Services (SES) Award review, confirming the superannuation increase for employees with disability scheduled for 1 October 2020 is deferred until 1 January 2021.NDS and the United Workers Union lodged submissions in support of the FWC's provisional decision made on 2 October deferring the increase until 1 January 2021.Following a request by NDS that the Commonwealth provide supplementation funding for the superannuation increase, the FWC indicated in January 2020 that it would defer further consideration of the matter until the Commonwealth provided a response.The Department of Social Services (DSS) lodged a submission [PDF] with the FWC, stating that the Commonwealth was not in a position to fund the first year of the rate of the superannuation increase. The main reason given was a concern that doing so may result in a shortfall in funding support for disability enterprises to cover the cost increase of the FWCâs proposed new wages structure. The Commonwealth had previously allocated $67 million to support disability enterprises transition to the new wages structure.NDS has been in discussions with DSS about the provision of supplementation funding for the superannuation increase. These discussions are ongoing and we will continue to keep members informed of SES Award review related developments.
